Federal Agency Halts Work on Atlantic Coast Pipeline Following Fourth Circuit Opinion
The United States Court of Appeals for the Fourth Circuit recently vacated a permit issued by the National Park Service to allow the Atlantic Coast Pipeline to tunnel under a portion of the Blue Ridge Parkway. The Fourth Circuit also vacated a permit issued by the U.S. Fish and Wildlife Service governing impact on endangered wildlife, finding that both agencies granted authorizations in contravention of their respective statutory requirements. As a result, the Federal Energy Regulatory Commission halted work until the permit issue could be resolved.
