PLANNING

The government or private entity designs and maps out projects, identifying parcels that will be affected.  Landowners can voice their opinions and potentially impact the design of a project.  However, this should never be done without the assistance of counsel as statements by landowners may be used against them at a later point when seeking just compensation for any taking. ACQUISITION

Once approved, the government or private entity notifies and makes offers to landowners.  The team at Kaufman & Canoles hires experts, including appraisers and engineers, as needed, to analyze the offer and assess just compensation. Condemning authorities will typically deny that a taking has caused damage to your property, and this is often not true. We are here to help, it’s the KaufCan difference.

LITIGATION

If a settlement or purchase agreement is not reached, the government or private entity will file a lawsuit to take the property.  The condemning authority must demonstrate that it has complied with all legal requirements before the land is condemned.  If the taking is permitted, a jury or commissioners will determine the payment the landowner will receive.
